Live Happily Academy is an online educational website owned and operated by Elevated Awareness, LLC.
The terms “we,” “us,” and “our” refer to Elevated Awareness, LLC. The term “Site” refers to livehappilyacademy.com and its associated online pages, platforms, and services. The terms “you,” “your,” and “user” refer to website visitors, customers, members, students, and other individuals who access or use the Site.
Live Happily Academy offers educational content, personal development courses, mindfulness instruction, live group programs, memberships, downloadable resources, community experiences, and related services.
By accessing or using the Site, creating an account, enrolling in a program, purchasing a membership, or participating in any offering, you agree to these Terms and Conditions.
If you do not agree with these Terms, please do not use the Site or purchase any of its offerings.
Eligibility
You must be at least 18 years old to create an account, purchase an offering, participate in a program, or enter into an agreement with Live Happily Academy.
By using the Site or purchasing an offering, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms.
Educational Nature of Our Services
Live Happily Academy provides educational content, coaching, mindfulness instruction, personal development resources, and opportunities for reflection and growth.
Our courses, programs, memberships, materials, and services are intended for educational and informational purposes.
They do not constitute medical care, psychotherapy, mental health treatment, legal advice, financial advice, or any other licensed professional service.
Participation in an Academy offering does not establish a physician-patient, therapist-client, attorney-client, or other licensed professional relationship.
Our services are not a substitute for care or guidance from a qualified healthcare provider, mental health professional, attorney, financial professional, or other appropriate specialist.
If you are experiencing a medical or mental health emergency, contact emergency services or seek immediate assistance from an appropriate professional.
Personal Responsibility and Results
You are responsible for your own decisions, actions, participation, and well-being.
Personal growth depends on many factors, including individual circumstances, engagement, and commitment. We do not guarantee any specific personal, emotional, professional, financial, or other outcome.
Testimonials and examples shared on the Site reflect individual experiences and do not guarantee that another person will achieve similar results.
Account Registration
Certain courses, programs, memberships, and resources may require you to create an account.
When registering, you agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.
Accounts are intended for individual use and may not be shared, transferred, or accessed by another person without our written permission.
Please notify us promptly if you become aware of unauthorized access to your account.
We reserve the right to suspend or terminate an account that contains inaccurate information, is shared without permission, or is used in violation of these Terms.
Courses, Programs, and Enrollment
Live Happily Academy may offer self-paced courses, scheduled group programs, live classes, workshops, memberships, and other educational experiences.
Some offerings are available only during specific enrollment periods or at selected times throughout the year.
Enrollment is subject to availability, payment, and any requirements stated for the particular offering.
We reserve the right to limit enrollment, adjust schedules, modify course content, reschedule sessions, or discontinue an offering when reasonably necessary.
If a scheduled program or class is canceled by us before it begins and no suitable alternative is provided, participants will receive a refund of amounts paid for the canceled offering.
Access periods, program features, live sessions, support, and other benefits may vary by offering and will be described on the applicable enrollment or sales page.
Payments and Pricing
Prices for courses, programs, memberships, and services are displayed at the time of purchase.
By completing a purchase, you authorize the applicable payment processor to charge the payment method you provide.
You agree to provide accurate billing information and keep your payment information current.
Prices may change at any time. A price change will not affect an already completed purchase unless otherwise disclosed at the time of enrollment or required by the terms of a recurring membership.
We may correct pricing errors, inaccurate descriptions, or technical issues and reserve the right to cancel a transaction affected by an obvious error. If payment has already been collected for a canceled transaction, the applicable amount will be refunded.
Payment Plans
Certain courses or programs may offer the option to pay in installments.
An installment plan is a commitment to pay the full purchase price of the program in scheduled payments. It is not a monthly membership that may be canceled simply by discontinuing participation.
Unless an applicable refund policy or guarantee states otherwise, you remain responsible for all scheduled payments, even if you stop attending, do not complete the program, or choose not to use the materials provided.
If an installment payment is unsuccessful, we may contact you to update your payment information and may suspend access until the outstanding payment is resolved.
Memberships and Automatic Renewals
When offered, membership subscriptions renew automatically according to the billing schedule disclosed at enrollment unless canceled before the next renewal date.
By purchasing a membership, you authorize recurring charges to your selected payment method at the price and frequency presented during checkout.
Membership fees, billing dates, and included benefits will be disclosed at the time of enrollment.
You may cancel your membership at any time through any available account cancellation option or by contacting us through the Site.
Cancellation prevents future renewal charges but does not automatically result in a refund for a billing period that has already begun, unless otherwise stated or required by law.
Access to membership materials and benefits generally continues through the end of the current paid billing period.
We may change membership pricing or benefits by providing reasonable advance notice when required. Any price change will apply to future billing periods, not to a billing period already paid.
Cancellations, Refunds, and Guarantees
Refunds, cancellations, and payment obligations are governed by the terms stated for the specific course, program, membership, or service at the time of purchase.
If a particular offering includes a stated guarantee or refund period, that guarantee or refund policy will apply according to its published conditions.
For programs that include a seven-day satisfaction guarantee following the first live session, a refund request must be submitted within the stated seven-day period and meet any participation requirements disclosed at enrollment.
Unless otherwise stated, refunds are not available after an applicable guarantee or refund period has expired.
Missing a session, choosing not to participate, failing to complete a program, or changing your mind after an applicable refund period does not automatically entitle you to a refund or release you from an agreed payment plan.

Live Sessions and Participation
Some courses and programs include live group calls, classes, workshops, question-and-answer sessions, or other interactive experiences.
Session schedules, participation requirements, and access instructions will be communicated to enrolled participants.
You are responsible for having a suitable telephone, internet connection, device, or other equipment necessary to participate.
We are not responsible for missed sessions resulting from personal scheduling conflicts, equipment problems, internet interruptions, or other circumstances outside our reasonable control.
We reserve the right to reschedule a live session when necessary. When reasonably possible, affected participants will receive advance notice.
Community Conduct
Participants are expected to contribute to a respectful, supportive, and considerate learning environment.
You agree not to:
Harass, threaten, intimidate, or discriminate against another person.
Share another participant’s private information without permission.
Post unlawful, defamatory, abusive, or inappropriate material.
Promote unrelated products or services without permission.
Disrupt a class, call, community discussion, or other offering.
Impersonate another person.
Record or distribute group sessions without written permission.
Misuse Academy materials, accounts, or community access.
We reserve the right to remove content, restrict participation, or discontinue access when reasonably necessary to protect participants, maintain a respectful environment, prevent misuse, or address a violation of these Terms.
When access is terminated because of a material violation of these Terms, refunds may be denied to the extent permitted by law.
Group Privacy and Confidentiality
Participants are expected to respect the privacy of others and refrain from sharing another participant’s personal information, experiences, or statements outside the group without permission.
Although we encourage discretion and mutual respect, group programs and community spaces involve other participants. We cannot guarantee that another person will maintain confidentiality.
Please use your judgment when deciding what personal information to share during a group call, class, community discussion, or other interactive experience.
Recordings
If a live session will be recorded, participants will be informed in advance.
Recordings, when provided, are intended only for authorized participants and may be subject to a limited access period.
You may not record, copy, download, reproduce, publish, distribute, or share any live session or recording without prior written permission.
Intellectual Property
All content available through Live Happily Academy, including website copy, course materials, workbooks, exercises, graphics, videos, recordings, guided practices, program names, teaching methods, downloadable resources, and other original materials, is owned by Elevated Awareness, LLC or used with permission.
The BE Code™ and other proprietary names, materials, and teaching resources remain the property of their respective owners.
Your purchase or enrollment grants you a limited, personal, nonexclusive, nontransferable license to access the materials included in your offering.
You may not copy, reproduce, republish, distribute, modify, sell, license, teach, publicly display, create derivative works from, or commercially exploit Academy materials without prior written permission.
You may download or print materials made available for download solely for your personal use.
Unauthorized use of our intellectual property may result in termination of access and other available legal remedies.
Materials You Submit
You may have opportunities to submit comments, questions, feedback, assignments, photographs, testimonials, or other materials through the Site or an associated program.
You retain ownership of content you create and submit.
By submitting content within a course, program, or community, you grant us limited permission to use, display, store, and process that content as reasonably necessary to operate the relevant offering and provide our services.
You agree not to submit material that infringes another person’s copyright, trademark, privacy, or other legal rights.
We reserve the right to remove submitted content that violates these Terms or is inappropriate for the relevant setting.
Testimonials and Participant Stories
We will request permission before publicly using your name, photograph, testimonial, or personal story for promotional purposes.
Any permission granted may be subject to reasonable limitations communicated at the time of your consent.
If you later wish to withdraw permission, contact us. We will make reasonable efforts to stop future use, although we may be unable to retrieve or remove materials that have already been printed, distributed, or shared by third parties.
Website Availability and Accuracy
We make reasonable efforts to keep the Site and its content accurate, current, and available.
However, we do not guarantee that the Site will always be uninterrupted, error-free, complete, or free from technical problems.
Information about courses, schedules, pricing, availability, and services may change.
We reserve the right to update, modify, suspend, or discontinue portions of the Site or its offerings when necessary.
Third-Party Services and Links
The Site may contain links to third-party websites or use third-party services for payments, hosting, learning management, email delivery, scheduling, video conferencing, analytics, or other functions.
We do not control and are not responsible for the content, policies, availability, or practices of third-party websites and services.

When you create an account, register for an offering, join an interest list, or contact us, we may communicate with you electronically about your account, purchases, registrations, programs, or related services.
You may unsubscribe from promotional emails at any time by following the unsubscribe instructions included in those messages.
Administrative communications concerning an active account, purchase, membership, or program may still be sent when necessary.
Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its content, materials, and services are provided on an “as available” basis without warranties of any kind, whether express or implied.
We do not guarantee that the Site will meet every user’s expectations, remain continuously available, or produce any particular result.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Elevated Awareness, LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or participation in an Academy offering.
This limitation applies to claims involving website interruptions, technical problems, unauthorized access, third-party services, lost data, personal dissatisfaction, or other issues arising from the use of the Site or its services.
To the extent permitted by law, any total liability arising from a particular offering will not exceed the amount you paid for that offering.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Indemnification
You agree to indemnify and hold harmless Elevated Awareness, LLC and its owners, employees, contractors, and representatives from reasonable claims, losses, liabilities, and expenses arising from your unlawful conduct, material violation of these Terms, misuse of the Site, or infringement of another person’s rights.
This obligation applies only to the extent permitted by law.
Changes to These Terms
We may update these Terms and Conditions from time to time.
Any revised version will be posted on the Site with an updated effective date.
When a material change affects an existing purchase, membership, or ongoing program, we will provide additional notice when required.
Your continued use of the Site after updated Terms are posted constitutes your acknowledgment of the revised Terms.
Governing Law and Venue
These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal proceeding arising from these Terms or your use of the Site must be brought in an appropriate state or federal court serving Palm Beach County, Florida, unless applicable law requires otherwise.
Before beginning formal legal proceedings, the parties agree to make a good-faith effort to resolve disputes through direct communication.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Waiver
Failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

You may not transfer or assign your account, enrollment, membership, access rights, or obligations under these Terms without our prior written permission.
We may assign our rights and obligations when reasonably necessary in connection with a business restructuring, transfer, or sale, subject to applicable law.
